Testpot Terms of Use

These terms are an agreement between you and Samra Global LTD, trading as Dry Run Studio, 128 City Road, London, EC1V 2NX, United Kingdom ("we", "us") for your use of the Testpot app. By using the app you accept them. If you don't agree, please don't use the app.

1. What Testpot does

Testpot lets you photograph a wall, pick a colour, and see a preview of that wall in the new colour.

Previews are approximations. The colour you see depends on your screen, the light in your photo, and the surface of the wall. Real paint will look different, and colours with similar names differ between paint brands. Always test real paint on the wall before you buy in quantity or start decorating. Testpot is not affiliated with any paint manufacturer unless the app says so.

Realistic previews are drawn by an AI image model. It repaints the whole picture, so small details elsewhere in the photo can change. Treat a realistic preview as an illustration, not as a record of your room.

2. Your photos

You keep all rights to the photos you upload. You give us permission to store and process them only as needed to produce your previews and show them back to you. How long we keep them is set out in the Privacy Policy.

You confirm that you have the right to upload each photo, and you agree not to upload photos that:

• show other people without their permission;
• are unlawful, or infringe someone else's rights;
• are sexually explicit or depict violence.

3. Free previews and subscriptions

The app includes a limited number of free previews. More previews, custom colours and higher resolution require a subscription.

A subscription includes unlimited quick previews and a weekly allowance of realistic previews. The app shows how many you have left. The allowance starts again each Monday, and unused realistic previews do not carry over.

• Plans and prices are shown in the app before you buy. Prices may vary by country and may change for future billing periods; the store will tell you before a change applies to you.
• Free trial. If a plan includes a free trial, you are charged the plan's price when the trial ends unless you cancel at least 24 hours before then.
• Renewal. Subscriptions renew automatically at the end of each period, and your store account is charged within 24 hours before the period ends, unless you turn off auto-renewal at least 24 hours before then.
• Cancelling. You manage and cancel a subscription in your Apple App Store or Google Play account settings. Deleting the app does not cancel it. After cancelling you keep access until the end of the period you paid for.
• Refunds are handled by Apple or Google under their policies. Nothing in these terms limits refund or withdrawal rights you have by law.
• Fair use. To protect the service we may apply a reasonable daily limit to the number of previews.

A subscription belongs to the store account that bought it. Use "Restore purchases" in the app to recover it on a new device.

4. Acceptable use

You agree not to:

• use the app for anything unlawful;
• copy, modify, reverse engineer or resell the app, except where the law allows this despite these terms;
• access our servers other than through the app, or automate requests to them;
• interfere with the service or try to get around limits on free previews.

We may suspend access for anyone who breaks these terms.

5. Our rights in the app

The app, its design, and its software belong to us or our licensors. We give you a personal, non-transferable, non-exclusive licence to use the app on devices you own or control, as permitted by the store's usage rules.

6. Changes and availability

We may change, add or remove features, and we may stop offering the app. If we end a paid feature during a period you have paid for, you may be entitled to a refund for the unused part, which you request through the store. We may update these terms; we will publish the new version at this address and update the date at the top. Continuing to use the app after a change means you accept it.

7. Disclaimer

The app is provided "as is". To the extent the law allows, we give no warranty that previews are accurate, that the app will be uninterrupted or error-free, or that it is fit for a particular purpose. You are responsible for decisions you make based on a preview, including what paint you buy and how much.

8. Limit of liability

To the extent the law allows, we are not liable for indirect or consequential losses, or for the cost of paint, materials or labour. Our total liability to you for all claims is limited to the amount you paid for the app in the 12 months before the claim.

Nothing in these terms excludes liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, for fraud, or under your statutory rights as a consumer.

9. Governing law

These terms are governed by the laws of England and Wales. If you are a consumer, you also keep the protection of the mandatory laws of the country you live in, and you may bring a claim in the courts there.

10. Apple App Store terms

If you downloaded the app from the Apple App Store, the following also apply:

• These terms are between you and us, not Apple. Apple is not responsible for the app or its content.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to meet a warranty that applies, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the extent the law allows, Apple has no other warranty obligation for the app.
• Apple is not responsible for claims relating to the app or your use of it, including product liability claims, claims that the app fails to meet a legal requirement, and consumer protection or privacy claims.
• If someone claims the app infringes their intellectual property rights, we, not Apple, are responsible for handling that claim.
• You confirm that you are not in a country subject to a US government embargo or designated as "terrorist supporting", and that you are not on a US government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
